Court Declares Suspension of Kwara Lawmaker, Hon. Saba Yisa Gideon, Unlawful and Nullifies Action

A Kwara State Revenue Court in Ilorin has ruled that the suspension of Hon. Saba Yisa Gideon, a member representing Edu State Constituency in the Kwara State House of Assembly (KWHA), is illegal, unconstitutional, and of no legal effect.

In a landmark judgment delivered by Justice Muritala Folorunsho, the court annulled the suspension imposed on the lawmaker by the Kwara State House of Assembly on December 18, 2025.

The suspension had been handed down for allegedly recording the proceedings of a House meeting without permission and sharing the footage with unauthorized individuals.

Justice Folorunsho explained that the action violated the rights of the lawmaker, particularly the procedure followed by the House.

“The suspension of the applicant by the respondents through a motion without notice was a procedural breach of his rights,” the judge stated.

The ruling also emphasized the lack of legal grounds for the suspension. “The suspension is not covered by the Legislative Houses, Powers, and Privileges Act or the rules of the Kwara State House of Assembly,” Justice Folorunsho declared. “It is therefore unconstitutional, unlawful, and null and void.”

Addressing the broader implications of the suspension, the judge affirmed that it amounted to an unlawful denial of Hon. Gideon’s constitutional rights.

The court also ordered that the lawmaker’s duties and responsibilities as an elected representative be reinstated immediately.

In a further step, Justice Folorunsho granted an injunction barring the House of Assembly and its officials from interfering with the lawmaker’s access to the assembly premises, including his office, chambers, and committee rooms.

The court also directed that all salaries and entitlements owed to Hon. Gideon be paid, including those withheld during the suspension period.

“Parties shall bear their respective costs,” the judgment concluded, marking a significant victory for Hon. Gideon in his quest for justice.

This ruling is expected to have broader implications on the relationship between lawmakers and the executive in Kwara State, highlighting the importance of respecting due process in legislative actions.
